State responds to Shrewsbury Twp. record request

The state Office of Open Records sent a letter to Shrewsbury Township regarding an open record appeal filed by a resident.

Kurt Kurzmiller filed an appeal after the township told him a tax record for the township's permit officer did not exist.

The letter from the open records office indicates that the township must certify the document does not exist, and it must create a letter denying the Kurzmiller request. The state's new Right-to-Know law requires agencies to write a letter explaining why they are denying the request.

Kurzmiller was the first person in York County to file an appeal with the open records office. The state's Right-to-Know law changed this year, allowing access to more records and providing a state office where appeals can be filed if record requests are denied.

There have been 87 appeals filed with the state since January, said Barry Fox, deputy director of the office.

So far, the state office has not issued any rulings, but there are several that should be issued soon, Fox said. The appeal rulings will be posted on the agency's Web site, http://openrecords.state.pa.us.
