Sales Tax records on Motor Vehicles

Recently, I gifted a motor vehicle to my grandaughter. When she went to PENNDOT to title and register the vehicle, she was told she must produce a receipt that Sales Tax was paid on the vehicle. The vehicle was also gifted to me by an ex-boyfriend and so, no Sales Tax was paid at the time the vehicle was transferred to me. Because no tax was paid by me, she was told that a reciept must then be obtained from the ex-boyfriend or else she would be liable to pay Sales Tax on the Fair Market Value of the vehicle. The reason the boyfrined is an ex is related to domestic violence issues. I do not want to contact the ex-boyfriend! I would think that the Sales Tx paid by him would be a matter of public record! How can I get a copy of his Sales Tax paid or a copy of his Vehicle Registration in order to prove the tax? The Pennsylvania Motor Vehicle Understated Value Program is entitling the state to collect sales tax ($235.50) when there is no sale simply because we cannot get the information? Ridiculous and unconstitutional! If there is anyone who knows where and how to obtain the information needed, please respond.

The state Right to Know Law is going to help you here or not, as individual sales receipts on motor vehicle transfers would be considered public record ... and the accessibility of motor vehicle records is controlled by the state's motor vehicle code.

(If there is another state or federal law that applies to the accessibility of a record, then the Right to Know Law does NOT apply.)

I'd suggest you or your granddaughter make a call to your local state representative's office, which should be able to help you in some way. (Dealing with state bureaucracies is part of a state rep's constituent services.)

You might also want to consult a reputable local motor vehicle title and registration service in your town ... They are experience in dealing with the state DMW, and should be able to advise you on whether or not there is a way to get around this issue.
